POVZETEK
Avtorska pravica kot ustavno zajamčena človekova pravica ne obstaja sama zase, temveč v družbi z vrsto drugih pravic in interesov. Tu so predvsem ustavne pravice in interesi družbe kot celote, zaradi katerih avtorskega monopola ni mogoče zmeraj dosledno uresničiti.
Pod pojem 'fanfiction' se v ožjem smislu štejejo amaterska dela navdušencev, ki nastanejo na podlagi del popularne kulture, določenih dogodkov, oseb ali celotnega domišljiskega vesolja nekega avtorskega dela.
Taka dela spadajo v kategorijo predelav oziroma derivativnih del, s katerimi ne sme priti do posega v pravico avtorja izvirnega dela.
Fanfiction je po eni strani lahko poseg v avtorsko pravico avtorjev, po drugi strani pa plod ustvarjalnosti fanov. Gre za povzemanje iz predhodnega dela in dodajanje ustvarjalnosti. Ta sekundarna kreativnost, ki je večinoma nekomercialne narave, si zasluži določeno zakonsko zaščito.
Digitalizacija je zabrisala tradicionalne vloge in odnose med ustvarjalci, založniki in uporabniki. Zato bo za dela, ki so plod skupnega avtorstva, kamor fanfiction nedvomno spada, v sistemu avtorskega prava treba na novo določiti obseg primernega varstva.

SUMMARY
Copyright as a constitutionally guaranteed human right does not exist for itself, but in the company of a number of other rights and interests. There are essentially constitutional rights and interests of society as a whole, for which the copyright monopoly can not be always fully realized.
Fanfiction is any kind of fan made written creativity that is based on segments of popular culture; events, characters or a whole imaginary universe. Such works belong to the category of modifications or derivative works with which there should be no infringement to the author of original work.
On one hand fanfiction can an infrigement of author's copyright, but on the other hand it's a derivative work made by fans. It echoes from the previous work and adding creativity transforms the original. This secundary creativity usually expressed in the noncomercial fanfiction deserves the protection of the law.
Digitization has blurred the traditional roles and relationships between creators, publishers and users. Therefore, for the works as a result of joint authorship, which fanfiction undoubtedly is, the copyright system has to be redefined to determine the extent of adequate protection.
